Session Description:

All Kansas healthcare providers, but particularly long-term care and senior-living providers, need to have a plan to handle issues related to gun ownership, gun possession, gun storage, and even gun use in their buildings or on their property. Both patients and staff of healthcare facilities have certain gun-related rights under applicable Kansas and federal law, including rights under Kansas’s conceal-care law (the Kansas Personal and Family Protection Act), and facilities often must strike a careful balance between protecting those rights and managing risks at their facilities. Furthermore, active-shooter situations are a significant issue of concern for all facilities, and active-shooter preparation has become an important part of emergency preparedness. This session will cover a variety of topics pertaining to gun-related compliance, risk-management, and planning both for governmental and private facilities, including compliance with the Kansas Personal and Family Protection Act, compliance with federal requirements related to gun safety and active-shooter situations, and best practice concerning staff and patient possession and storage of guns.

Objectives:

  • Provide an overview of the current legal and compliance risks related to gun possession and storage for long-term care and senior-living facilities.
  • Become familiar with key Kansas laws related to gun ownership and conceal-carry rights.
  • Identify gun-related compliance concerns that are specific to governmental providers.
  • Detail gun-related signage requirements for healthcare facilities.
  • Provide a summary of rules related to staff or patient storage of guns in their personal vehicles.
  • Understand federal rules pertaining to gun access and use in long-term care facilities.
  • Become familiar with best practices for preparation and planning for active-shooter situations.
  • Cover ways in which facilities can reduce their risk of liability for a gun-related issue or incident.
